Cancel APC 2023 Presidential Candidacy ~ Abuja Lawyer Tells Court

An Abuja based legal counselor, Osigwe Momoh has documented a case to the Federal High Court against the All Progressive Congress (APC) for picking the Presidential and Vice Presidential Candidate of the party from a similar religion for the 2023 presidential election.




In the suit, the lawyer requested the court for a request from unending directive controlling the Independent Electoral Commission( INEC) from distributing the name of the Presidential Candidate of the APC, Bola Tinubu over supposed infringement of the Nigerian constitution.

The APC, Tinubu and INEC were named as first, second and third respondents deferentially.

Momoh, in the beginning brings contended that ideological groups must, by ideals of Chapter Two of the 1999 constitution of the Federal Republic of Nigeria, as changed, have their Presidential and Vice Presidential applicants from various tribe and various religious group of the country.


He, in this manner, looked for a statement that, "by uprightness of Sections 14 (1) and (3), 15 and 224(a) of the 1999 constitution of the Federal Republic of Nigeria, as changed, the litigants are limited by the standards of Chapter Two of the 1999 Constitution, as corrected and having the Presidential and Vice Presidential competitors of a similar religion is unlawful and invalid and void.


"That all ideological groups must, by prudence of Chapter Two of the 1999 Constitution of the Federal Republic of Nigeria as revised, have their Presidential and Vice Presidential Candidates from various sectional ancestral and strict gatherings of the country.


"A request invalidating the bid of the APC, Tinubu, same being unlawful and against the soul and letters of Sections 14 (1) and (3), 15 and 224 (a) of the changed 1999 Constitution of the Federal Republic of Nigeria."


The freedoms lobbyist mentioned the court to limit the INEC from distributing the candidate of APC as an official possibility for the impending 2023 general political decision.


In the interim, no date has been fixed for knowing about the suit.
